Is Online Gambling Legal in New York?

Online casino play gambling is not yet legalized. There have been recent efforts to bring it to the state, including separate bills for both online casino play and poker, but they didn’t make the annual budget. With that, online casino play will have to wait until 2025 at least.

That said, online sports betting and sweepstakes casinos are legal. Online sports betting has been legal since January 2022, and retail sports betting was legal three years before.

Sweepstakes casinos follow a different set of laws than real-money online casinos, so these are permitted in mostly every state in the United States. 

How Do Sweepstake Casinos Work?

When you log onto a sweepstakes casino, you’ll find they resemble the many real-money online casinos in the six legal states.

But what’s the difference? Why are these allowed, but real-money casinos aren’t?

Sweepstakes casinos don’t use real money for you to play with them. Instead, you have two virtual currencies—Gold Coins and Sweeps Cash. The numerous sweepstakes casinos have varying names, but those are the two types. All sites will have the option to toggle between the two.

Gold Coins are used only for fun. Nothing more, nothing less.

However, Sweeps Cash can be used to exchange for real money or gift cards, depending on the site.

At most sites, you need 50 Sweeps Cash to redeem a prize, and they usally carry a 1:1 value.

When Will New York Legalize Real Money Online Casinos?

At the beginning of 2023, bills were introduced that promoted the expansion of iGaming in the state, including online casino and poker play.

On January 17, Assemblyman Gary J. Pretlow filed A01380, a bill for online poker. A couple of weeks later, the DraftKings and FanDuel CEOs lobbied for iGaming legislation to come to New York. Then, a couple of weeks after that, on February 15, Senator Joseph Addabbo proposed S4856, a bill to legalize online slots, table games, and live dealer games. 

That same day, the AGA reported that New York represented 13.7% of the market share in sports betting ($1.37 billion Gross Gaming Revenue). While these are sports betting figures, it does illustrate New Yorkers’ penchant for iGaming, which could trickle down to online casino play.

However, on March 15, it was discovered that iGaming legislation didn’t make the annual budget, so it was off the table for 2023. 

Moving forward, a 2025 launch seems more than doable. Nearby, New Jersey and Pennsylvania both have legal online gambling, and New York would benefit significantly from the tax income it would offer. 

Expect more of a push for iGaming in 2025 in The Empire State. 

What Online Casinos to Expect in New York?

While we might be a year or so away from online casino play officially coming to New York, it’s as good a time to speculate what sites we could see launch.

Pretlow filed A01380 for online poker play. Sen. Joseph P. Addabbo proposed S4856, iGaming legislation to legalize online slots, table games, and live dealer games in February. In the end iGaming legislation didn’t make the annual budget.

In 2024, Sen. Joseph P. Addabbo continued pushing for legalization of online casino in New York with his new bill S9226 in which online poker would be define as a game of skill. This bill would allow state to issue 10 online licenses, with each license costing ten million dollars and 15% of their gross revenue from interactive poker. This bill has meat stern opposition from NYC casino workers who accused Sen. Joseph P. Addabbo of trying to take away their jobs.

If bill S9226 gains traction we can expect online casinos to become legal at earlier 2025, but more realistically 2026.

When it comes to online sports betting, NY state already crossed that bridge by legalizing in January 2022. Right now, there are 9 online sportsbooks operating there, which is quite remarkable considering it also has the highest online tax rate at 51%.
