Dozens of states have made sports betting legal, but California is not one of them. Thus, they have used their political influence to prevent California lawmakers from making a serious effort to make sports betting legal.

California residents have also rejected the notion of legal sports betting in the state. In 2022, Californians rejected both Proposition 26 and Proposition 27 on statewide ballots. Proposition 26 would have legalized retail sports betting in Native American casinos, while Proposition 27 would have legalized online sportsbooks. Both measures were defeated by large margins, indicating that a majority of California residents have no interest in legalizing sports betting. Putting a sports betting proposition on the ballot in the future is possible, but the earliest it would happen is 2028. Also, there appears to be no serious traction in favor of online sports betting in California.

Why Has California Sued Polymarket?

The state of California isn’t actively suing Polymarket, although the platform is dealing with legal issues inside the state. For starters, some California residents are among the plaintiffs in a federal class-action lawsuit against Polymarket and similar event trading platforms. 

There are also two California-based Native American tribes suing Polymarket and a similar prediction platform. The tribes are claiming that futures trading on sporting events is akin to sports betting, which violates the Indian Gaming Regulatory Act, which gives the tribes exclusive gaming rights in the state of California. In September 2026, the Ninth Circuit ruled in favor of the Native American tribes, meaning Polymarket can’t be used on tribal lands. However, Polymarket continues to operate legally throughout California outside of Native American territory.

What Happens to My Open Positions if California Bans Polymarket?

If California were to suddenly ban Polymarket, it would prevent anyone in the state from trading new contracts. However, all existing contracts would be allowed to reach their natural conclusion. States banning trading sites like Polymarket can get messy, but being federally regulated helps to protect users.

Typically, even if no new contracts are possible, open contracts can be held until the event ends and the market closes. In some cases, a sudden shutdown will mean forced liquidation of open positions. While rare, if this were to happen, users would either be refunded the original price of their open contract or receive the current market value of that contract. How Polymarket Works: Event Contracts Explained

For instance, for a sporting event, you would decide “yes or no” on whether a specific team will win a game. Both options will have a price between 1¢ and 99¢ attached. The price is tied to the probability of that event based on the market’s perception, meaning the trading of contracts by others for that event can influence the price.

Events priced closer to 99¢ are considered more likely, offering a smaller payout, while the closer to 1¢, the more unlikely that event is to come to fruition, meaning a larger payout. For example, if the “yes” option for an event has a price of 70¢, the market believes it has a 70% probability.

When an event concludes, losing contracts are settled for $0, while winning contracts are settled for $1. The profit is the difference between $1 and the original price of the contract, so a contract purchased for 70¢ will earn a profit of 30¢. Of course, many Polymarket users will purchase multiple 70¢ contracts to increase their potential earnings.
