Is Kalshi Legal in California?

It’s possible that another sports betting measure will be on the ballot for voters in 2028. However, there are no immediate plans to legalize sports betting in California.
Why Has California Sued Kalshi?
The state of California hasn’t sued Kalshi directly. Rather, two Native American tribes in California (the Blue Lake Rancheria and the Chicken Ranch Rancheria) have sued Kalshi and a similar market prediction platform. The tribes argued that Kalshi’s sports prediction trades too closely resemble sports betting. They also claimed that Kalshi operating in California violated the Indian Gaming Regulatory Act by violating the exclusive gaming contract the tribes have with the state of California.
In September 2026, the Ninth Circuit Court of Appeals ruled in favor of the two tribes, finding they are likely to succeed in arguing that Kalshi's sports contracts violate the Indian Gaming Regulatory Act when offered on tribal lands. The court reversed the lower court's denial of the tribes' injunction request and sent the case back to the district court to decide whether to actually block Kalshi. No ban is in effect yet, and Kalshi remains available elsewhere in California outside tribal territory.
Is Kalshi Safe to Use in California?

What Happens to My Open Positions if California Bans Kalshi?
Since Kalshi is federally regulated, all open positions and trades would be protected if Kalshi were to be suddenly banned and forced to shut down in California. That being said, there are a few possible scenarios for open trades.
One option is that all open contracts would be immediately settled based on current market value. They would not necessarily be settled after the conclusion of the event but right away if Kalshi were no longer operating.
Another option would be to void all open trades. This would refund the original stake as if that trade was never placed.
Because Kalshi operates under the Commodity Exchange Act and CFTC oversight, it has wind-down and customer-protection obligations, so open positions would most likely be settled at market value or voided and refunded rather than lost. Exact treatment would depend on the circumstances and any regulatory guidance at the time.
How Kalshi Works: Event Contracts Explained

All contracts come with a “yes or no” option for whether that event will occur. For example, will a specific team win an upcoming game—yes or no?
