Why Does New York Have No Legal Online Sports Betting?

New York actually does have legal online sports betting. In January 2022, mobile sports betting officially launched for all residents of New York, as well as visitors to the state, as long as they are physically in New York when placing a sports wager. The New York State Gaming Commission is responsible for regulating online sports betting and has issued licenses to nine different online sportsbooks.

Why Has New York Sued Kalshi?

In July 2026, the state of New York sued Kalshi for operating an unlicensed sports betting site. While Kalshi is considered a financial exchange platform, New York argues that its futures contracts on sporting events are akin to sports betting. In that case, Kalshi would be operating a sports betting platform in New York without a proper license.

In its lawsuit, New York also claims that Kalshi is circumventing some of its restrictions on sports betting. For instance, New York’s age requirement for placing sports bets is 21, but Kalshi allows anyone 18 or older to trade contracts. New York’s sports betting laws also ban wagers on in-state college teams, individual player bets in college games, and award futures. Since Kalshi allows contract trading in these areas, New York claims the platform is accepting wagers that have been banned in the state.

Ultimately, New York is hoping to stop Kalshi from operating within its borders, while also levying fines and forcing it to forfeit past profits from New York users. New York claims that Kalshi hasn’t been paying proper taxes for operating a sports betting platform and that it is operating without safeguards that protect users who engage in sports betting.

Is Kalshi Safe to Use in New York?

As a federally regulated platform, Kalshi is safe to use in New York and every other state. Kalshi takes proper measures to encrypt personal data, protecting its users from cybersecurity threats, so in that sense, Kalshi is perfectly safe to use in New York. What Happens to My Open Positions if New York Bans Kalshi?

If New York were to win its lawsuit against Kalshi, the platform would likely have to cease operations in the state. Registered Kalshi users with an IP address based in New York would no longer be able to trade event contracts.

All open or unsettled contracts would likely be void, with the original purchase price refunded to the user. This means there may not be an opportunity to cash out early or receive market value for any unsettled event contracts. In its lawsuit, New York is also hoping to have any proceeds Kalshi has made from New York users returned to users.

How Kalshi Works: Event Contracts Explained

At Kalshi, users trade event contracts of real-world events. Every contract is resolved with a simple “yes or no.” For instance, a contract regarding a sporting event may be phrased: “Will this team win, yes or no?” For a contract related to pop culture, the contract may be phrased: “Will this artist win a specific Grammy award, yes or no?”

All Kalshi contracts have a price attached to them between 1¢ and 99¢. This price reflects the market value of the contract and the probability of that event happening. While the price can change for a particular event based on market value, once a futures contract is purchased, the price is locked in for the Kalshi user buying that contract.

The higher the value attached to the contract, the more likely that event is to happen. Therefore, contracts closer to 99¢ are more likely, and contracts closer to 1¢ have a lower probability of happening. If a contract is listed at 80¢, the implied probability is 80%, according to the market.

When an event concludes, all contracts are settled for $1. This means the payout for a winning contract is the difference between $1 and the price paid. For instance, if a contract was purchased for 80¢, the contract holder will receive $1, meaning they earned a profit of 20¢. Of course, you can purchase as many 80¢ contracts as you want to increase your potential profit.
