Eligibility

The Sweepstake is open to individuals who are Registered Users; (ii) residents of the United States; (iii) who are twenty-one (21) years of age or older (or the majority age in their state of residence, whichever is older), at the date of registration for the Sweepstake. For clarity purposes, persons who reside in Rhode Island, Florida or New York are expressly EXCLUDED from participating in this Sweepstake.

Official Rules

• You must have provided your email address in order to participate in the Sweepstake competition.

• The Sweepstake will run for the entire tournament. Brackets entered will only be accepted up until the 12:00 pm EST cutoff on ESPN on 3/17/23.

• All scoring is hosted by ESPN and WSN holds no responsibility or liability for scoring erros.

• One bracket entry per person for the contest is permitted.

• The winner is the person who wins is the person is scores highest on ESPNs rankings inside our pool.

• The Prize is the cash prize, or other item of value, as advertised on the game page.

• In the event of a tie, the Company shall randomly select a winner.

• The winner will be contacted by email and the contest prize will be delivered by said email.

• If a winner does not respond and claim their Prize in ten (10) days, then we will select another winner who had the next highest score. If there were no other clear winners, the Company has the discretion to cancel the Prize or to carry out another draw.

• The winner may be required to present identification.

• The Company may suspend the Sweepstake at any time at its sole and absolute discretion.

• When creating usernames and participating in the leadership board, no profanity shall be allowed. Profanity is grounds for immediate termination of login credentials and blacklisting of the associated email, as well as but not limited to, exclusion from future contests, at the discretion of the company.

• Any username created by the contestant should not reflect their own name, and the user is responsible for the usage of any personal name when creating a username, and any consequential outreach to them if they choose to use their real name. The contestant is fully responsible for sharing any private information via its chosen username. The company shall be excluded from any and all liability in this respect.

Legal Disclaimer

All players must agree to abide by the terms and conditions of the Official Rules, and the following legal disclaimers listed below, which are binding upon all participants for matters pertaining to the Sweepstake.

General Conditions

By entering into the Sweepstake, each individual accepts and agrees to be bound by the rules and decisions of the company, which are final and binding. In relation to acceptance of a Prize, all taxes, if any, are the sole responsibility of the individual Winner. Where required, the Company may deduct withholding taxes from the Prize. Such Winner is not able to transfer or substitute the Prize. The Company has the right to substitute or transfer a Prize for one of equal or greater value.

Unless prohibited by law, the acceptance of a Prize by a Winner constitutes permission for the Entity to make use of the Winner’s redacted personal information which includes; name; likeness; statements, and address (state and city). This information may be displayed worldwide and in all forms of media without compensation, unless prohibited by law.

Upon creation of usernames each individual accepts and agrees to avoid the use of profanity in said names. Such usage of profanity will result in termination of the individual’s account and blacklisting of participation in any and all future contests. The user is at all times responsible for creating a username that does not reflect their real name, and the company shall in no event be held liable for any unwanted communication if they do otherwise.

All local, state, federal laws and regulations will apply.

The Company is not responsible for any loss, late or misdirected online entries or forms of transactions, for incorrect entry information that is caused by a contestant, equipment, or technical malfunction, or for any human errors, technical errors or malfunctions. The Company has the right to modify or stop the Sweepstake at any time during the Sweepstake Period, if events that are beyond their control affect the Sweepstake fairness or integrity or due to changes in Applicable Law. Should any scheduled game be postponed or cancelled for any reason, no Prizes will be distributed for that week.

The Company is not responsible for human or technical errors in the offer or administration of this Sweepstake. Where there are manifest errors in the process the Company will forfeit the Prize or can decide to award the Prize to the correct winner, if the winner is clear and known, and provided that the Prize has not already been paid out.

The Company may at its sole discretion, disqualify any applicant from participating in the Sweepstake. Should the entrant engage in any conduct that the Company deems as improper, unfair or otherwise adverse to the operation of the Sweepstakes or detrimental to the other entrants. Improper conduct included, but is not limited to, falsifying any personal information that is required during the Sweepstake registration process or Prize claim, violating any term or condition stated herein, accumulating points or Prize through automatic computer scripts or any other form of programming techniques, allowing other individuals to use the entrant’s personal information for the purpose of accumulating points or a Prize, being underage, being from a state or country from where participation was prohibited, tampering with the administration of this promotion, or intentionally trying to defraud, reverse engineer, disassemble, decompile or otherwise tamper with the programs on this website. Winners shall acknowledge that forfeiture of a Prize or return of a Prize will not prevent the Company from pursuing other avenues of recourse.

The Company has the right to modify rules for further clarification without affecting the term of the Sweepstake.

It is prohibited to use this Sweepstake for any form of gambling, betting or wagering.

Internet Occurrences

In the case of Internet portion of the program not running as planned, including infection through a virus, tampering, fraud, technical failures or any other cause beyond the control of the Company which in turn shall affect the security and administration, as well as the fairness and integrity of this Sweepstake, the Company has the right to disqualify any individual who has tampered with the entry process, and to terminate or modify the Sweepstake. Should this event take place, the Company reserves the right to distribute a Prize to the entrant with the highest total weekly and overall score from the list of participants who have entered the Sweepstake.

The Company shall not be held responsible for any form of error, breach, interruption, deletion, delay in service or transmission, communications line malfunction, theft or loss or unapproved access to, or modification of, entries or transactions. The Company shall not be liable for any malfunction that shall occur of any telephone network, computer on-line systems or the Company’s computer hardware, software, failure of any email entry or transaction that is received on account of technical difficulties or traffic congestion found on the Internet or on any website, or any form of combination, including computer related damages sustained by the participant which result from downloading any material related to the Sweepstake.

Lost Entities

The Company is not responsible for, and thus you hereby forever waive any rights to any claim in connection with corrupted, lost, stolen, late, incomplete or postage-due entries; or for any electronic hardware or software malfunctions, unapproved human intervention or the incorrect capture of any information. The Company is not liable for the any incorrect information caused through registration submitted by end users or through tampering or hacking, or any programming associated with or used in this Sweepstake, and assume no responsibility for any form of error or defect in operation or transmissions, theft or unapproved access to this Sweepstake.

Damaged Equipment

The Sweepstake Entity is not responsible for, and assumes no liability for, and you waive any right to any claim in relation to, any damage or injury to participants or to any entrants property which results through the participation of the Sweepstake or downloading of materials for the Sweepstake.

ANY ATTEMPT BY AN ENTRANT T0 DELIBERATELY CAUSES DAMAGE TO ANY WEBSITE OR UNDERMINES THE OPERATION OF THE SWEEPSTAKE IS CONTRARY TO CIVIL AND CRIMINAL LAWS. SHOULD SUCH ATTEMPT BE MADE, THE COMPANY HAS THE RIGHT TO SEEK DAMAGES FROM SUCH PARTICIPANT TO THE FULL EXTENT PROVIDED BY LAW.

If the Sweepstake is challenged by any legal authority, the Company has the right to modify or suspend the Sweepstake, or disqualify any participant who resides in the geographic area where such Sweepstake is being challenged. The Company is not liable to any of the participants who are disqualified from participating due to such an event.

Force Majeure

Should any event beyond the control of the Company occur, resulting in prevention of prize distribution or continuation of the Sweepstake, which includes but is not limited to, flood, fire, natural epidemic of health, explosion, labor strike, act of God, equipment failure, riot or civil disturbance, war, terrorist threat or activity, public health crisis, order of any court or jurisdiction, or any other cause beyond the Company’s control, the Company reserves the right to suspend, alter or terminate the Sweepstake. In such a case, the Winner of a Prize shall be selected at random drawing of all eligible entrants.

The Sweepstake Entities are not responsible for, and you waive any right to claim in relation to, errors and ambiguity: in the Sweepstake; in any advertising or promotion of the Sweepstake; or/and in the Official Rules including, but not limited to errors arising in advertising, Official Rules, selection and announcement of Winners and the awarding of Prizes. Should an error occur in relation to the Official Rules, the Company may modify such Official Rules for further clarity or to correct such errors without affecting the terms and conditions of the Sweepstake.

Each participant, including and not limited to, the Winners, hereby release and agree to hold harmless the Sweepstake Entities and their respective employees, liable for any damage or loss to any person or property that arises directly or indirectly, from the acceptance or misuse of a Prize, participation in this Sweepstake or any other related activities that arise out of the participation of such Sweepstake.

Limitation of Liability

IN NO EVENT WILL THE COMPANY BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSS THAT OCCURS THROUGH DIRECT, INDIRECT, INCIDENTAL OR PUNITIVE DAMAGES THAT ARISE OUT OF THE USE OF SUCH SERVICES AND/OR THE SWEEPSTAKES, DOWNLOADING FROM OR PRINTING MATERIAL THAT HAS BEEN DOWNLOADED FROM ANY WEBSITE THAT IS ASSOCIATED WITH THE SWEEPSTAKE ENTITY. IN NO EVENT SHALL THE RELEASED COMPANY’S TOTAL LIABILITY COSTS DUE TO YOUR LOSS OR DAMAGE EXCEED $100. WITHOUT LIMITING THE FOREGOING, EVERYTHING INCLUDED ON THE SWEEPSTAKE AND THE SERVICE PROVIDED, WHICH INCLUDES THE PRIZES, ARE PROVIDED ‘AS IS’ WITHOUT THE WARRANT OF ANY EXPRESS OR IMPLIED, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR REASON OR NON-INFRINGEMENT. CERTAIN JURISDICTIONS MAY NOT ALLOW FOR THE LIMITATION OR EXCLUSION OF LIABILITY FOR DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES. THUS SOME ABOVE LISTED LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. CHECK YOUR LOCAL LAWS FOR RESTRICTIONS REGARDING THESE LIMITATIONS.

Arbitration

The parties waive all their rights to a trial in any action in relation to the Official Rules, including the Sweepstake. Should a dispute arise in connection with the Official Rules or the Sweepstake, shall be settled through arbitration in accordance with the rules of the American Arbitration Association. Every claim shall be arbitrated on an individual basis and shall not be consolidated in any arbitration with any claim of another party. The participant waives the right to a class action lawsuit. The arbitration shall be conducted in the State of New Jersey.

Governing Law

THE OFFICIAL RULES AND INTERPRETATION OF THE CLAIMS SHALL BE GOVERNED IN ACCORDANCE WITH THE LAWS OF NEW JERSEY. ANY MATTER WHICH IS NOT SUBJECT TO ARBITRATION AS SET FORTH IN THESE OFFICIAL RULES AND/OR IN RELATION TO THE ENTERING OF ANY JUDGEMENT ON AN ARBITRATION AWARD CONCERNING THE OFFICIAL RULES AND/OR THE SWEEPSTAKE, THE PARTIES IRREVOCABLY CONSENT TO THE EXCLUSIVE JURISDICTION AND VENUE OF THE STATE AND FEDERAL COURTS LOCATED IN OR CLOSEST TO THE COUNTRY OF THE UNITED STATES IN THE STATE OF NEW JERSEY. THE PARTIES AGREE NOT TO RAISE THE DEFENCE OF FORUM NON CONVENIENS.

The Company will be collecting personal data about the participants online, in accordance with its privacy policy. By signing up the Company may store your personal information and may contact you with products or services that the Company deems to be interesting to you. You may unsubscribe from any marketing communications at any time.
