Kalshi Files Lawsuit Against Ohio Sports Betting Regulator
The lawsuits continue to pile up for Kalshi.
The sports prediction market operator has filed a lawsuit against the Ohio Casino Control Commission (OCCC), asking the court to overrule its cease-and-desist order. The regulator accused Kalshi of offering unregulated sports betting in the state, and demanded that they either meet all regulations or exit the market by October 20.
Kalshi’s latest lawsuit is similar to many others they are currently engaged in. The general argument from states is that the operators are offering a form of sports betting, while Kalshi and other industry allies have continued to insist the markets are a form of commodity trading.
The operator is also arguing that the OCCC’s warning to sportsbooks over prediction markets is an attack on their ability to do business. Kalshi has been in talks with some sportsbooks over potential partnerships, but the OCCC has now made it clear that those partnerships could lead to sports betting licenses being pulled. As a result, Kalshi believes the state is intentionally interfering with the company’s ability to do business.
The Ohio court reviewing the new lawsuit will need to work quickly if Kalshi wants to operate in the state after October 20.
History of Exaggerated Claims Could Haunt Kalshi
The people running Kalshi’s public response to the mounting lawsuits clearly haven’t heard the story of “The Boy Who Cried Wolf.”
The operator has launched an aggressive public messaging campaign to sway voters to support the new industry. Their tactics have become more outrageous as the battles drag on, culminating in their claim that banning sports prediction markets could cripple the global economy.
You don’t need to be an economist to understand that Kalshi’s warning over the economic impact of the industry is a massive exaggeration. That is something Americans will remember, creating a negative image of the industry leader. That means the arguments made in lawsuits like the one against the OCCC won’t resonate and could only further increase the opposition against sports prediction markets.
