Massachusetts Becomes Latest State to Take Kalshi to Court

The Bay State is on the offensive against sports prediction markets.

Massachusetts Attorney General Andrea Joy Campbell has filed a lawsuit in a Suffolk Superior Court against Kalshi EX LLC. The lawsuit alleges that the operator is offering sports betting without following any of the state’s regulations. They are asking for the platform to be shut down in the state and for Kalshi to pay fines for each violation.

Unlike the other states currently battling with Kalshi, Massachusetts didn’t take any action until now. They skipped the cease-and-desist letters and public investigations, allowing them to go on the offensive instead of waiting for the industry-leading operator to take legal action.

“This lawsuit will ensure that if Kalshi wants to be in the sports gaming business in Massachusetts, they must obtain a license and follow our laws. I am grateful for the ongoing partnership with the Gaming Commission,” Attorney General Campbell said after filing the lawsuit.  “As part of today’s filing, the AGO is requesting that the court order Kalshi to cease offering sports wagering in Massachusetts while the lawsuit is pending.”

Kalshi is expected to file a motion to have the case moved to federal court after confirming its plans to fight the new lawsuit.

Kalshi Steps Up Public Campaign

While Kalshi was somewhat reserved during 2024, the company has expressed defiance in the face of mounting lawsuits. They continue to advertise their sports prediction markets as a way of legally betting on sports in all 50 states, even as their legal team is arguing the opposite point in court.

A recent poll from the AGA showed the American public views sports prediction markets as sports betting. That has resulted in Kalshi ramping up its messaging to the public, claiming the opposition is skewing the story to protect their revenue. They have also begun to argue that shutting down the new industry would lead to a massive blow to the US economy, though there is plenty of reason to doubt the claim.
