May 2018: In Murphy v. National Collegiate Athletic Association, the court struck down the 1992 federal law (PASPA) that banned sports betting. This decision, while specific to sports, affirmed states' rights to regulate gambling and ignited the nationwide expansion of both sports betting and online casinos.
Oct. 2017: Pennsylvania Governor signs the state's online gambling bill into law. The first legal online casinos went live in 2019.
Nov. 2013: Delaware becomes the first US state to launch full-scale real-money online casino gambling. New Jersey follows a few days later.
April 2013: Nevada launches the first legal, real-money online gambling site. Ultimate Poker went live, making Nevada the first state with legal online gambling. However, the market was (and remains) restricted to online poker only, not casino games.
Sept. 2011: The DOJ responds to the request from New York and Illinois regarding the sale of lottery tickets online. The DOJ concluded that the Wire Act only pertains to sports betting. April 2011: Black Friday happens. The DOJ shut down online poker and casino sites still operating in the US post-UIGEA.
Dec. 2009: New York and Illinois ask the DOJ to clarify whether or not the Wire Act applies to online lottery ticket sales. As the tickets would be sold by a state entity (i.e., based in the US), this wouldn’t contravene UIGEA.
Oct. 2006: The Unlawful Internet Gambling Enforcement Act of 2006 (UIGEA) shuts down the US online gambling industry. UIGEA made it illegal for gambling companies not based or licensed in the US to process payments from US residents.
2000 to 2006: Online gambling wasn’t regulated at the federal or state level during this period. Operators were based offshore and offered their services in dozens of countries in addition to the US.
Where Are Online Casino Sites Legal?
Unfortunately, the best online real-money casinos aren’t available in every US state. Unlike countries with national laws, such as the UK, US gambling regulations are fractured.That’s due to a lack of federal regulation and differing state views. Therefore, what you have in the US is a system of state regulation based on the Tenth Amendment (aka states’ rights).This gives state lawmakers the power to regulate online gambling activities as they see fit. For example, Florida has legal sports betting but not online casino gaming. On the other hand, New Jersey has regulated all forms of online gambling, including real-money casino gaming, sports betting, and poker.I can’t tell you why every state hasn’t gone down the same road as New Jersey. The good news for those of you in states without legal online casinos is that the legal landscape is always evolving.So, even if you can’t use real-money casinos right now, that may not always be the case. Currently, these seven states have real-money online casino gambling:
Connecticut
Connecticut is one of the smallest online casino gaming states in the US, but it’s also one of the most forward-thinking. Governor Ned Lamont signedHouse Bill 6451 into law on May 25, 2021. That opened the door to legal online casino gambling in Connecticut, along with poker.
Bucking the trend in other top online casino states, Connecticut’s two licensed sites went live within weeks of House Bill 6451's signing. Those sites, DraftKings and FanDuel, are linked to Connecticut’s two tribal casino operators, the Mashantucket Pequot and the Mohegan Tribe.
In an effort to give residents access to more of the best casinos online, Connecticut lawmakers introduced a bill that permits interstate agreements. If written into law, SB 1464 would allow people in Connecticut to access and play alongside their counterparts in other states.
Delaware
Delaware online casino regulations were introduced in 2013, and three operators, Williams Interactive, Scientific Games, and 888 Holdings, became the first license holders.
It’s never been the most active state in terms of online casino gaming, which is why the state’s regulator, the Delaware Lottery, has been receptive to change. For example, in 2024, Delaware added sports betting to its list of regulated activities alongside poker and casino gaming.
Another important change came a year before, in 2023, when Rush Street Interactive replaced 888 Holdings as the Delaware Lottery’s official software provider. The deal made BetRivers the sole online casino platform in the state. Three retail casinos are connected to BetRivers, but they all share the same underlying software.
Michigan
Michigan lawmakers did a two-for-one deal for residents in 2019 when they simultaneously approved the Lawful Internet Gaming Act and the Lawful Sports Betting Act. Both bills were signed into law by Governor Gretchen Whitmer, which handed control of the industry to Michigan’s Gaming Control Board (MGCB).
The MGCB initially started issuing licenses in 2020. However, due to COVID-19 shutdowns, the process took longer than expected. Eventually, the first 10 real-money online casinos launched in 2021.
In line with state regulations, online sites in Michigan must be linked to land-based casinos and/or tribal gaming operators, such as the Lac Vieux Desert tribe.
Under Governor Chris Christie, the New Jersey Division of Gaming Enforcement was given the green light to license online operators. With Atlantic City already a hub for land-based casinos, there were plenty of operators wanting a license.
Brands have come and gone over the years, but there’s always a core group of eight real-money online casino sites in New Jersey. These casino sites need a land-based partner.
